COPYRIGHT NOTICE AND INTELLECTUAL PROPERTY RIGHTS POLICY

This Copyright Notice and Intellectual Property Rights Policy governs your access to and use of crictracker.online, associated mobile applications, and related content, features, and functionality (collectively, the “Service”), operated by CricTracker Pvt Ltd (“Company,” “we,” “us,” or “our”).

1. Copyrighted Works

1.1 Protected Content

Unless otherwise stated, all original content on the Service is protected by applicable copyright law, to the extent it meets the requirement of originality, including:

  • Original Authored Works: delete "statistics, team rankings".

  • Compiled and Curated Data: "The selection and arrangement of live score compilations and statistical databases, to the extent protected as a compilation or database." Delete "schedule data" and "performance metrics".

  • Graphic and Design Elements: delete "typography".

  • Technical Content: "Website software, source code and the structure of our databases." Delete "algorithms" and "integration frameworks.

1.2 Third-Party Content

Certain images, team logos, player likenesses, syndicated news feeds, or video highlights appearing on the Service are owned by third parties (e.g., cricket boards, photographers, agencies, and broadcasters). Such content is used under license or as permitted by fair dealing under Section 52 of the Copyright Act, 1957 and remains the intellectual property of its respective owners. 

2. Copyright Ownership & Rights

  • Exclusive Ownership: Except for Third-Party Content (Section 1.2) and User Content (which remains owned by its author, subject to the licence in our Terms and Conditions), CricTracker Private Limited retains full ownership of all original content, derivative compilations and structural software code.
  • No Rights Transferred: Accessing or using the Service does not transfer any ownership, copyright, or intellectual property rights to you.
  • Moral Rights: The Company respects the moral rights of authors under Section 57 of the Copyright Act, 1957 and enforces them on its authors' behalf, to the extent permitted by law.

3. Prohibited Uses

Unless explicitly permitted in writing or under applicable law, you are strictly prohibited from:

  • Reproduction & Distribution: Copying, storing, redistributing, or republishing substantial portions of our content across print, digital, or social platforms without authorization.

  • Commercial Exploitation: Selling, monetizing, licensing, or incorporating CricTracker content into commercial applications, feeds, or advertisements.

  • Automated Data Extraction & AI Training: Utilizing web scrapers, bots, crawlers, or automated tools to extract scores, stats, or text, or using CricTracker content to train artificial intelligence (AI) and machine learning (ML) models.

  • Framing & Mirroring: Embedding, hotlinking, or framing CricTracker content on external sites in a manner that creates confusion or implies endorsement.

  • System Circumvention: Attempting to bypass access controls, paywalls, rate limits, or digital rights management (DRM) protections.

4. Permitted Limited Use

Subject to strict compliance with this policy, users are granted a limited, revocable, non-exclusive, non-transferable licence for personal, non-commercial use:

  • Personal Reading: Viewing and reading content on personal devices for non-commercial educational or recreational purposes.
  • Minimal Social Sharing: Sharing brief quotes or excerpts (up to 100 words) with clear attribution (“© CricTracker”) and a direct hyperlink back to the original source article on crictracker.com.

5. Trademark Protection

The name “CricTracker”, logo, brand assets, taglines, and domain names and associated brand identifiers (registered or unregistered), protected under the Trade Marks Act, 1999 and common law are trademarks and trade dress of CricTracker Pvt Ltd. You may not use these trademarks in connection with any product or service without prior written consent, nor in any manner that causes consumer confusion or disparages the brand. 

6. Copyright Infringement & DMCA Takedown Procedure

We respect the intellectual property rights of others and expect our users to do the same.

6.1 Filing a Takedown Notice

If you believe that your copyrighted work has been copied or posted on the Service in a way that constitutes infringement, please submit a notice containing:

  1. Physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with sufficient detail (e.g., exact URLs) to enable us to locate it.
  4. Your contact details (full name, address, telephone number, and email address).
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement under penalty of perjury that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.

6.2 Counter-Notice Procedure

If material you submitted was removed due to a copyright notice and you believe the removal was a result of mistake or misidentification, you may submit a counter-notice to contact@crictracker.com detailing your legal claim and contact information.

7. Contact Information & Governing Law

This policy is governed by the laws of India, including the Copyright Act, 1957, the Trade Marks Act, 1999 and the Information Technology Act, 2000. Nothing limits any rights available under international treaties to which India is a party, such as the Berne Convention. Disputes are subject to the dispute resolution clause in our Terms and Conditions.
